Terms of Use

These Terms of Use ("Terms") govern your use of the redLUX Guitar mobile application (the "App"), published by redLUX Guitar ("we," "us"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. License
Subject to your compliance with these Terms and Apple's Licensed Application End User License Agreement (EULA) in Apple's App Store Terms of Service, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, for your personal, non-commercial use, in accordance with Apple's usage rules.
2. Apple as a Third-Party Beneficiary
You acknowledge that these Terms are between you and us only, not with Apple Inc. ("Apple"), and Apple is not responsible for the App or its content. Apple has no obligation to furnish maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) to you; to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation. Apple is a third-party beneficiary of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
3. Your Content
Progressions, lyrics, song titles, and recordings you create in the App ("Your Content") remain yours. We claim no ownership over Your Content. Because the App stores Your Content locally on your device, you are solely responsible for backing it up (for example, through your device's standard backup features); we have no access to Your Content and cannot recover it if it is lost.
4. Acceptable Use
You agree not to: reverse engineer, decompile, or disassemble the App except as permitted by applicable law; use the App for any unlawful purpose; or attempt to circumvent any access or purchase restrictions built into the App.
5. In-App Purchases & Pricing
The App may offer optional Pro features unlocked through a one-time or recurring in-app purchase, processed entirely through Apple's App Store. All billing, refunds, and payment disputes are handled by Apple under Apple's own terms and policies. Pricing and feature availability are described within the App and may change in future updates.
6. No Warranty
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by applicable law.
7. Limitation of Liability
To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from or related to your use of the App.
8. Changes to the App or Terms
We may update the App and these Terms from time to time. Material changes to these Terms will be reflected by an updated "Last updated" date above. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
9. Termination
You may stop using the App at any time by deleting it from your device. We may suspend or discontinue any part of the App at our discretion, including in response to a violation of these Terms.
10. Governing Law
These Terms are governed by the laws applicable in the jurisdiction in which the developer is established, without regard to conflict-of-law principles, except where local consumer protection law requires otherwise.
